Former Nelson resident convicted of criminal negligence waits for Chief Justice to determine future

A former Calgary woman with ties to Nelson will need to wait until (Monday) November 3 to await her fate following a sentencing hearing Friday in Calgary.

That’s when Court of Queen’s Bench Chief Justice Neil Wittmann will render his decision on former Nelson resident, 27-year-old Amie Nottebrock.

Nottebrock was convicted in May of two counts of criminal negligence causing death in the Jan. 8, 2012 crash which killed Danielle Russell, 24, a passenger in her car and the driver of another vehicle, Arshdeep Brar, 20.

Nottebrock was driving an estimated 140 km/h when she blew through a red light and collided with another vehicle.

During the time of the collision, Nottebrock had about triple the legal alcohol limit in her blood when the collision occurred.

A sample of Nottebrock’s blood taken when she was hospitalized by an expert estimated her blood/alcohol concentration at between 222 and 270 mg per 100 ml of blood.

The legal limit is 80.

Crown prosecutor Jonathan Hak is calling for a five-to-six-year prison term.

Nottebrock’slawyer Alain Hepner is asking for a lesser sentence — a four year term — due to the fact of his client’s otherwise unblemished record and the fact she hasn’t drank since the crash.

Nottebrock is the daughter of former Nelson doctor Doug Nottebrock.

The family lived in Nelson before moving to Kelowna approximately 10-12 years ago where Doug Nottebrock continued to practice medicine.
